You Don’t Have to Suffer in Silence

Injured employees in Illinois are entitled to workers’ compensation benefits. These benefits are paid by the employer’s workers’ compensation insurance. This state-mandated program also covers pre-existing conditions if the employee’s job made the condition worse.

You cannot legally lose your job, be demoted, or otherwise be punished for reporting a workplace injury. The law prohibits employers from retaliating against injured workers who file workers’ compensation claims.

FAQs

What benefits are available through workers’ compensation insurance?

Injured workers in Illinois are entitled to compensation to cover:
• Medical treatment and prescribed medications
• A portion of your lost wages
• Disability caused by permanent injuries

You may also be entitled to vocational retraining if you are permanently unable to return to your previous line of work.

Are all work-related injuries covered by workers’ compensation insurance?

No. Although most work injuries are covered regardless of fault, a few exceptions apply.
• Injuries that occur while an employee is intoxicated or under the influence of drugs are generally not covered.
• Self-inflicted injuries are not covered.
• Injuries that occur while a worker is violating company policy are not covered.
• Injuries that happen while the worker is committing a serious crime are not covered.

Are my injuries covered if I was hurt while working from home?

It depends. If you are classified as a full or part-time employee and the accident happened while you were performing your job duties at home, you are entitled to workers’ compensation benefits. However, if you are an independent contractor, a domestic employee in a private home, a business owner, or an unpaid volunteer, your injuries may not be covered.

What Our

Penny Matherly

Dave was a great lawyer. He explained everything thoroughly and always kept me up to date on any issues or changes. He also was very quick to answer my phone calls and emails. His response time was always same day or the next day. When it came to negotiations he fought for me til we got what we wanted and he never stopped. I highly recommend him to anyone and I will definitely always refer him to anyone that I know that needs representation. Thank you so much Dave for everything you did for me. I really appreciate you.
